Abercrombie & Fitch logoA federal court has ruled that a   Muslim American can proceed with the lawsuit  filed against  Abercrombie & Fitch after it rejected her job application when she wore a hijab or Muslim head covering to her interview, reports BusinessInsurance.com.

The Equal Employment Opportunity Commission filed a religious discrimination suit because of what it said were the constantly changing reasons Abercrombie and Fitch gave for not hiring the teenager for a stock room position.

The store chain has maintained it had legitimate reasons for not hiring Halla Banafa.

“The EEOC has submitted sufficient evidence to generate a question of material fact as to whether Ms. Canasa’s (Abercrombie & Fitch store manager) justification has shifted and what import that change may carry,” the judge ruled
