A federal judge stepped in to at least temporarily stop the Trump administration from revoking the visa of a student from India without warning or due process.
Republic World reports the Department of Homeland Security stripped 21-year-old Krish Lal Isserdasani of his visa because of his arrest in November on a charge of disorderly conduct.
Isserdasani has not been convicted of the charge nor did DHS give him a chance to explain.
“He was given no warning, no opportunity to explain or defend himself, and no chance to correct any potential misunderstanding,” said Judge Judge William Conley of the Western District of Wisconsin.
Isserdasani’s attorney, Shabnam Lotfi, told Business Today the ruling represented “a rare win for international students. The judge heard us.”
Judge Conley said Lofti’s challenge had a “reasonable likelihood of success” and set a preliminary hearing for April 28.
The student is in his final year before getting his degree in computer engineering .
The ruling stops ICE from both detaining or deporting him.
