A Korean American soldier accused of raping an intoxicated women he met in a nightclub in Seoul has been acquitted of the charges.
The soldier faced the charge of “quasi rape.” Quasi rape is when the victim is unable to resist.
The court ruled “it is difficult to see the situation in which the victim had sexual relations with Mr. A as one in which she was unable to resist or could not protest… simply because the victim does not remember what occured does not enable the court to determine her intention or judge her unable to have resisted.” reported the Asian Correspondent.
The victim worked as a waitress in a nightclub, had drinks together and then went to a motel to have sex.
