A judge has ordered that the frozen embryos from a divorced couple be destroyed, reports ABC7 News.
Mimi Lee and Stephen Findley signed a joint agreement that if they were to ever be divorced, the embryos would be destroyed.
Because of cancer and Lee’s advancing age, she can no longer have children and has fought to keep the embryos after their divorce.
“I stay focused on my babies and knowing that I’m their mom,” an emotional Lee told Good Morning America this past summer.
Lee’s efforts have been opposed by the fertility clinic.
“If the court had said, ‘Well these are not going to stand up to scrutiny in these kinds of cases, all the work that we do at centers like this to predetermine what’s going to happen, would be thrown out potentially,” said Dr. Carl Herbert from San Francisco’s Pacific Fertility Center.
