The family of a six year old has filed a wrongful death suit against the on demand car service Uber and its driver for the accident that struck and killed six-year-old Sofia Liu on New Year’s Eve in San Francisco, reports ABC7
Uber has declined to cover the accident or its driver with its insurance saying he was off duty at the time of the accident.
That accident also injured Sofia’s mother and her five-year old son.
“What he was, was on their app available for people to pick him as a driver, which is the very essence of Uber’s business,” said family attorney Christopher Dolan.
Uber thinks otherwise.
“The driver was not providing services on the Uber system during the time of the accident.” Meaning, there was no passenger in the car.
