Judge blocks Trump’s executive order restricting birthright citizenship

A federal judge in Maryland has blocked President Donald Trump’s executive order, which aims to essentially end birthright citizenship, CNN reports.

During a hearing on Wednesday, US District Judge Deborah Boardman issued a nationwide preliminary injunction blocking the executive order from going into effect on February 19. A federal judge in Seattle put the executive order on hold two weeks ago.

Boardman, according to The Hill, said the executive order likely violates the 1888 Supreme Court decision on birthright citizenship.

“The United States Supreme Court has resoundingly rejected the president’s interpretation of the Citizenship Clause of the 14th Amendment,” Boardman said, per The Hill. “In fact, no court in the country has ever endorsed the president’s interpretation. This court will not be the first.” 

The executive order, signed by Trump on his first day in office, would restrict children born in the U.S., without at least one parent who is a U.S. citizen or lawful permanent resident, from being automatically granted U.S. citizenship.

According to Reuters, it is unclear whether or not the Trump administration will appeal the decision. However, a U.S. Justice Department lawyer did ask Judge Boardman for 60 days to respond to her injunction at Wednesday’s hearing.
